It is a criminal offense, per the federal statute cited in the article. It ight also be considered obstruction of justice, which is of course another crime. Prosecuting anything pertaining to the violent uprising on Jan. 6 can be perceived as related to politics--which is what Merrick Garland seems want to avoid. But destruction of documents of any sort may be more easily prosecuted. I hope.
