We certainly do, and he can now do it without legal consequence since SCOTUS has given presidents this power. He can declare Trump a danger to the nation and put him in prison without legal consequence. I think it is unlikely he will, though. He's old school, when Republicans were a bit more honorable than they are now and Trump would never have become president.
